What Is The Difference Between Collaborative Law, Divorce Mediation and Arbitration?

Collaborative law, mediation and arbitration can provide efficient, cost-effective and far more personalized agreements in family law and divorce, but each method involves a unique legal process:

  • Collaborative law: Each party in collaborative law proceedings has independent representation from his or her attorney. The clients, rather than lawyers, are the driving forces behind every decision. Lawyers serve as facilitators for reaching a solution with a focus on the prioritized interests of his or her client. This differs from negotiations in litigation, which are more focused on legal positioning.
  • Mediation: In contrast to collaborative law, mediation generally involves only one facilitator between the two parties. This mediator does not act as an attorney for either party. Each individual may or may not have outside consulting counsel during the process, but in every case it is advisable to have an independent lawyer review any agreements made through mediation.
  • Arbitration: A method of dispute resolution involving one or more neutral third parties who are usually agreed to by the disputing partied and whose decision is binding.
